Terms and Conditions

Terms and Conditions: By accepting any work order, quote, or estimate provided by Tree Medicine Tree Service LLC., any of its representatives or agents, whether it being written or verbal, that allows for work to be scheduled, started or completed, the customer is bound by the following terms and agreements.

Acceptance includes verbal acceptance via telephone or in person: or via email or written communications.
It is agreed by and between Tree Medicine Tree Service, LLC (TMTS) and the customer and/or customer’s agent (Customer), that the following provisions are made as part of this contract:
PAYMENT OPTIONS: Please note that payment is due upon completion of work outlined in the accepted estimate. We accept cash, check or credit card.
A 2.5% processing fee will be added to all credit card payments.

There will be a $25.00 fee charged for all checks returned to our office for non-sufficient funds.
A 5% fee will be added monthly to any balance that is 30 days or longer passed due.
SUBCONTRACTORS: TMTS reserves the right to hire subcontractors and/or independent contractors to complete any work described in the above estimate. Customer and/or customers agent agrees to, and understands that any work performed in relation to the above estimate may be completed by a subcontractor/independent contractor hired by Tree Medicine Tree Service, LLC.
INSURANCE BY CONTRACTOR: TMTS warrants that it is insured for liability resulting from injury to person(s) or property and that all employees are covered by Workers’ Compensation as required by law. Certificates of coverage are available upon request.
COMPLETION OF CONTRACT: TMTS agrees to do its best to meet any agreed upon performance dates, but shall not be liable in damages or otherwise for delays because of inclement weather, labor, or any other cause beyond its control; nor shall the customer be relieved of completion for delays. We request that any cancellation from the customer be done with 24 hours.
TREE OWNERSHIP: The authorizing party warrants that all trees and described items listed on the attached estimate are located on the customer’s property, and, if not, that the authorizing party has received full permission from the tree owner to allow TMTS to perform the specified work. Should any tree be mistakenly identified as to ownership, the customer agrees to indemnify Tree Medicine Tree Service, LLC for any damages or costs incurred from the result thereof.
SITE CONDITIONS: We reserve the right to charge a fee of $50 for excessive pet waste, hazards or clutter left in work zone by customer.
SAFETY: TMTS warrants that all arboricultural operations will follow the latest version of the ANSI Z133.1 industry safety standards. The Customer agrees to not enter the work area during arboricultural operations unless authorized by a TMTS representative. Customer is to stay at least 50′ outside of the perimeter of branch growth on any tree being serviced.
DRIVEWAYS/SIDEWALKS: TMTS will attempt to minimize any damage to driveways and sidewalks. But in the event that our equipment causes settling, cracking, or other damage to driveways and/or sidewalks, then repairs are not included in the contract price. Tree Medicine Tree Service, LLC is not responsible for damages to driveways, sidewalks, and other hardscapes.
LAWN AND LANDSCAPE REPAIR: TMTS will attempt to minimize all disturbances and damage to the customer’s lawn and landscape. Repairs are not included in the contract price, unless noted otherwise on this proposal. Tree Medicine Tree Service, LLC is not responsible for damages such as divots and holes created from falling branches and logs to lawn, foot traffic, or any damage from hauling out work site debris to turf, and other yard landscaping or property.

Denver Emerald Ash Borer

    1. What is Emerald Ash Borer?

The emerald ash borer, Agrilus planipennis, is a green beetle native to Asia and Eastern Russia that feeds on Ash trees (Fraxiness spp.). Outside its native region, the emerald ash borer (also referred to as EAB) is an invasive species, and emerald ash borer infestation is highly destructive to ash trees in its introduced range. The Emerald Ash Borer was first discovered in America in June of 2002 in Michigan. It is believed to have been brought to America unintentionally in ash wood which was used to stabilize crates during shipping, and has been responsible for the death of over 150 million ash trees in the Mid and Eastern US.

    1. Is Emerald Ash Borer a problem in Denver?

EAB is now considered the most destructive forest pest ever seen in North America. The scope of this problem will reach the billions of dollars nationwide if not dealt with. State and federal agencies have made this problem a priority.
Emerald Ash Borer was found in boulder County in late September of 2013. Although it has not been officially found in the Denver Metro Area, we expect that it is only a matter of time before it is problematic for Denvers ash tree population. The only way to know if your ash tree has EAB, is to have it inspected by an arborist familiar with Emerald Ash Borer.
Eventually every ash tree in Denver will have Emerald Ash Borer and left untreated will die.

    1. What are the treatment options for EAB

Tree Medicine recommends that people within 15-20 miles of Boulder county or that have “high value” ash trees call us for an systemic trunk injection of Emamectin Benzoate.

People who live outside of the 15-20 mile radius of Boulder County should call us for a soil injection treatment of Imidicloprid. CONTACT US

    1. What if I don’t treat my ash tree?

Because Emerald Ash Bore Larva chew S shaped galleries that destroy water and nutrient conducting vessels, the tree will eventually lose the ability to conduct water and will die of draught stress. Chemical treatment is the only known way to protect the tree and kill the insect.

This is very useful for certain urban settings where spray drift can be an issue. With this service, the treatment is injected in the tree directly and there is no exposure to the surrounding area.
